Creation of the antimonopoly authority goes back to the acceptance of the Law of RK “On competition development and restriction of monopolistic activities” on June 11, 1991, in connection with this, by the decision of the President of the Republic of Kazakhstan, the State Committee on support of new economic structures and monopolistic activities restriction was created in August 1991. This law was one of the first “market” laws of the country aimed to develop the entrepreneurship in new conditions of economic reform. By the Order of the President of Kazakh SSR in accordance with the approved law, the State Committee of Kazakh SSR on support of new economic structures and restriction of monopolistic activities was established and the Decree No. 428 “Issues of the State Committee of Kazakh SSR on support of new economic structures and restriction of monopolistic activities” was signed on August 31, 1991.
The Committee was under the supervision of the President of the Republic and was accountable to the Supreme Soviet. The Committee had very high status, highlighting the great importance that the nation’s leaders placed to the entrepreneurial development.
Driller Christian Davidovich was appointed the First Chairman of the Committee.
The main tasks of the Committee were: support of entrepreneurship, competition development, prevention and suppression of monopolistic activities and abuse of a dominant position, control of compliance with the antimonopoly legislation. Function and powers of the Committee were rather wide. It conducted the expertise of the draft laws and other regulatory legal acts associated with the market functioning and competition development. Developed measures to support the entrepreneurship, to create new economic structures, to develop the market competition. Moreover, the Committee presented the reports on the market and competition state, proposals on improving the antimonopoly legislation to the Supreme Soviet and the Cabinet of Ministers of the country.
In 1992, the Committee was reformed into the State Antimonopoly Policy Committee and was included into the Cabinet of Ministries. Svoik Petr Vladimirovich was assigned the Chairman of the Committee.
During this period, such ministries as: the Ministry of Consumer Industry and Public Service, the Ministry of Food Industry, Glavsnab KazSSR, were demonopolized and reformed into the national holdings and subsequently were segmented.
Further in 1994, the Committee was reorganized through the merger with the Pricing Committee and had been functioning as the State Committee on Pricing and Antimonopoly Policy (SCPAP) for a long time. In 1996, Radostovets Nikolay Vladimirovich headed the Committee.
The Committee implemented housing and utility reforms, demonopolized the city passenger and inter-city passenger transport and performed the coordination functions on the implementation of the regulations of the Law “On protection of consumer rights”. Due to this, there appeared over 100 communities on protection of consumer rights in the republic and in cooperation with the Supreme Court, the Decree No.7 “On the practical use of the legislation on protection of consumer rights by the courts” dated July 25, 1996 which facilitated the further consumerism development in Kazakhstan was approved.
In 1998, by the initiative of the Committee of the Committee, the Law of RK “On natural monopolies” was developed.
By the Order of the President of the Republic of Kazakhstan dated October 13, 1999, the Committee was reformed into the Agency of the Republic of Kazakhstan on Regulation of Natural Monopolies, Protection of Competition and Support of small business. To carry out the assigned functions, the territorial antimonopoly departments with direct subordination to the Agency in the regions of Kazakhstan were established. The Agency was headed by Tleuberdin Altay Ablayevich. Then, during the period between 2000 and 2004, the Agency was headed by Imashev Berik Mazhitovich, Dossayev Yerbolat Askarbekovich, Zhandossov Oraz Aliyevich and Sagintayev Bakhytzhan Abdirovich.
By the Order of the President No.1107 dated June 13, 2003, the Agency was transferred to the authority of the President, but in one year on June 9, 2004, by the Order of the President No.1382, the Agency was returned to the Government of the Republic of Kazakhstan.
On September 29, 2004, in accordance with the Order of the President of the Republic of Kazakhstan No. 1449, the functions on regulating the natural monopolies and on protection of competition were divided. The Agency on regulation of natural monopolies received the functions of pricing regulation, in different years, the Agency was chaired by Sagintayev Bakhytzhan Abdirovich (2004-2007), Aldabergenov Nurlan Shadibekovich (2007-2012), Ospanov Murat Magavyanovich (2012-2014).
And the functions on protection of the competition were transferred to the Ministry of Industry and Trade of the Republic of Kazakhstan, where the Committee on protection of competition was established. Matishev Aliakpar Bolatovich was assigned the Chairman of the Committee.
On October 13, 2007, in accordance with the Order of the President of the Republic of Kazakhstan No.425 “On measures to further improve the system of state administration of the Republic of Kazakhstan”, the Agency of the Republic of Kazakhstan on Protection of Competition (Antimonopoly Agency) was established instead of the abolished Committee on Protection of Competition. In different years, it was chaired by Yessenbayev Mazhit Tuleubekovich (2008-2012), Abdrakhimov Gabidulla Rakhmatullayevich (2012-2013), Kuandykov Bolatbek Bayanovich (2013-2014), Orazbekov Galym Isbassarovich (01.2014-08.2014).
Currently, by the Order of the President of RK No.872 dated August 13, 2014, the Agency of RK on Regulation of Natural Monopolies and the Agency of RK on Protection of Competition were reorganized by the merger into the Committee on Regulation of Natural Monopolies and Protection of Competition of the Ministry of National Economy of RK. By the Order of the Ministry of National Economy of RK dated August 15, 2014, Zhumangarin Serik Makashevich was assigned the Chairman of the Committee.
